3.5

Any personal data you send us will be handled in line with our Privacy and Cookie Policy.

4. Access to the Platform

4.1

Access to the Platform and its free features is free of charge. Free features currently include the club directory, the events calendar, Free Listings for clubs, and the ScoreCard and Field Card tools. Paid Services are subject to our Terms of Sale.

4.2

You are responsible for making the arrangements you need to access the Platform, including your internet connection and device.

4.3

The Platform is provided “as is” and “as available”. We may suspend or withdraw the Platform, or any part of it, at any time. We do not guarantee that the Platform will always be available or uninterrupted. Where we can, we will give you reasonable notice of any suspension or withdrawal. This does not affect any rights you have under a contract for Paid Services.

5. Changes to the Platform

5.1

We may update and change the Platform from time to time, for example to reflect new features, changes to our services or changes in the law. If we make a significant change, we will try to give you reasonable notice.

6. Changes to these Terms of Use

6.1

We may change these Terms of Use from time to time. The date at the top shows when they were last updated. If we make significant changes, we will highlight them on the Platform and, if you have an Account, tell you by email.

6.2

If any part of the current version of these Terms of Use conflicts with a previous version, the current version applies unless we say otherwise.

7. Accounts

7.1

Some features, such as sharing User Content or managing a club listing, may require an Account.

7.2

You must be 18 or over to create an Account. Shooters aged 13 to 17 may only have an Account with the consent of a parent or guardian, who is responsible for their use of the Platform. Children under 13 may not have an Account.

7.3

The information you give us when creating an Account must be accurate and complete, and you must keep it up to date.

7.4

You must keep your login details safe and must not share them. If you think someone else is using your Account, change your password immediately and contact us using the details in Part 3.

7.5

You must not use another person’s Account without their permission.

7.6

You can delete your Account at any time. When you do, you will lose access to the features that need an Account, and your personal data will be deleted or retained as explained in our Privacy and Cookie Policy. Deleting your Account will also delete User Content you have shared, except where Part 12.4 applies.

7.7

We may suspend or close your Account if, in our reasonable opinion, you have breached these Terms of Use or our Acceptable Use Policy.

8. Shooting, Safety and the Law

8.1

The Platform is an information, events and community service for the shooting community. We do not organise or run shooting events, and we do not provide shooting instruction or coaching.

8.2

Clubs, shooting grounds and event organisers are responsible for their own events, including safety, supervision, insurance, eligibility and compliance with the law. Event details on the Platform are supplied by organisers. Please check the details directly with the organiser before you travel or book.

8.3

You are responsible for complying with all laws that apply to you. These include the Firearms Acts, the conditions of any firearm or shotgun certificate you hold, and the rules of any ground or club you attend.

8.4

We are not affiliated with any police force, the Home Office or any firearms licensing authority. Nothing on the Platform verifies, grants or replaces a firearm or shotgun certificate, or any other licence, permission or insurance.

8.5

We are not affiliated with, or endorsed by, any governing body or organisation named on the Platform unless we expressly say so.

9. ScoreCard and Field Card

9.1

The ScoreCard and Field Card are free tools for keeping your own records of your shooting.

9.2

Records you enter are self-reported. They are not verified by us and are not official scores, classifications or records of any governing body, club or competition, unless we expressly say otherwise.

9.3

The Field Card is designed to record game shooting days responsibly. It is not a competition to achieve the largest bag. Please use it in line with good practice and the law.

9.4

If we offer you the option to carry your records into MyShoots® Pro, we will explain how this works before you choose to do so.

10. How You May Use the Platform and Content (Intellectual Property)

10.1

Apart from User Content (see Parts 11 and 12), all Content on the Platform, and the copyright and other intellectual property rights in it, belongs to us or our licensors unless it is labelled otherwise. This includes the design of the Platform, the ScoreCard and Field Card, and the MyShoots® name and logos. All Content is protected by UK and international intellectual property laws and treaties.

10.2

You may view and use the Platform in a web browser, and your device may download parts of it for caching.

10.3

You may print one copy of, and download extracts from, any page for your personal, non-commercial use.

10.4

You may download and save Content where we clearly indicate that it is available for download, for your personal use only.

10.5

You may not use Content (including User Content) for commercial purposes without a licence from us, our licensors or the relevant User, as applicable. This does not prevent clubs and businesses from using the Platform for its normal purposes.

10.6

You may not copy, scrape, extract or download Content (including the club directory, events calendar and User Content) systematically, whether manually or by automated means, to create a collection, directory or database, or to train or develop any software or artificial intelligence model, without our written permission.

10.7

Except as these Terms of Use allow, you may not reproduce, copy, distribute, sell, rent, sub-license, store or otherwise re-use Content from the Platform without our written permission (or that of the relevant User).

10.8

Our status (and that of any identified licensors or Users) as the owner and author of the Content must always be acknowledged.

11. User Content

11.1

User Content includes club and shooting ground listings, event submissions, logos, images and videos, community posts and comments, uploaded photographs (such as scorecards) and records you choose to share.

11.2

An Account or a completed submission form is needed to submit User Content.

11.3

All User Content, and all communications with other Users, must comply with our Acceptable Use Policy.

11.4

When you submit User Content, you confirm that:

11.5

You are responsible for any loss or damage we suffer as a result of a breach of Part 11.4. If you are a business User, you will also indemnify us against any such loss or damage.

11.6

We may review, edit for format, reject, reclassify or remove User Content that, in our reasonable opinion, breaches our Acceptable Use Policy or these Terms of Use, or is inaccurate or out of date. Events are removed from the calendar automatically once they have finished.

11.7

User Content is not checked by us before it appears on the Platform, except for club listings and calendar events, which we review before publication. The views expressed in User Content are those of the User concerned and not our own.

11.8

If someone claims that User Content you have submitted infringes their intellectual property rights or privacy, we may disclose your identity to them where the law allows.

11.9

We do not guarantee that User Content will not be lost. Please keep your own copies of anything important.

12. User Content: Your Rights and Ours

12.1

You (or your licensors) keep ownership of your User Content and all intellectual property rights in it.

12.2

When you submit User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing or reformatting), publish and display it on the Platform. The licence also allows us to use it to promote the Platform and the relevant club, event or brand, including on our social media channels and newsletters. We may sub-license these rights to the service providers that help us run the Platform.

12.3

This licence ends when you delete the User Content or your Account. However, we may continue to use it where it has already been included in promotional material or shared with others before deletion, and where we need to keep it for legal reasons.

12.4

Other Users may not copy, distribute, publicly display or create derivative works from your User Content without your permission, except as these Terms of Use allow. We cannot guarantee that other Users will not copy User Content without permission.

13. Reporting Content and Complaints

13.1

If you see Content on the Platform that you believe is illegal, harmful, or in breach of our Acceptable Use Policy, please report it by emailing info@myshoots.io with the subject line “Report”, or by using any reporting tool we provide on the Platform. Please tell us where the Content is and why you are concerned.

13.2

We will review reports promptly. We will remove illegal content swiftly once we become aware of it, and we may report it to the relevant authorities.

13.3

If we remove your User Content or restrict your Account, we will normally tell you why, unless the law or a safety concern prevents us. If you think we have made the wrong decision, you can ask us to review it by contacting us using the details in Part 3.

13.4

More detail on how we handle reports is set out in our Acceptable Use Policy.

14. Links to the Platform

14.1

You may link to any page of the Platform, provided that you do so fairly and lawfully and do not damage our reputation or take unfair advantage of it.

14.2

You must not link in a way that suggests any association with, approval of or endorsement by us where none exists.

14.3

You must not use our logos or trade marks without our written permission.

14.4

You must not frame or embed the Platform on another website without our written permission.

14.5

You must not link to the Platform from a website whose main content is unlawful, obscene, offensive, dishonest, defamatory, threatening or discriminatory; that promotes violence, hatred or terrorism; that infringes intellectual property rights; or that we reasonably consider objectionable.

15. Links to Other Sites and Affiliate Links

15.1

The Platform contains links to other websites, including club, brand and partner websites. Unless we say otherwise, we do not control those websites and are not responsible for their content, products or services.

15.2

Some links to brands and retailers are affiliate links. If you buy something after clicking one of these links, we may earn a commission, at no extra cost to you. Affiliate links do not affect which clubs or events appear on the Platform.

16. Advertising, Premium Listings and Partners

16.1

Clubs, brands and partners may pay for Premium Listings, featured placement or partnership packages. Paid placements are identified as such on the Platform.

16.2

Each advertiser, brand and partner is responsible for the content of its own advertising and listings, including any offers and prices. We are not responsible for any errors or omissions in them.

16.3

We may display advertising or sponsored content on the same page as User Content. You must not remove or hide it.

17. Disclaimers

17.1

Content on the Platform is for general information only. It is not professional, legal, safety or firearms licensing advice. Always seek appropriate professional advice, and follow the instructions of the club or ground, before taking part in any shooting activity.

17.2

We make reasonable efforts to keep our own Content accurate and up to date, but we cannot guarantee that it always will be. We do not guarantee the accuracy of User Content, including event information supplied by organisers.

17.3

If you are a business User, we exclude all implied representations, warranties, conditions and other terms that may apply to the Platform and its Content, to the extent permitted by law.

18. Our Liability

18.1

Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

18.2

If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Use or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. We provide the free Platform for domestic and private use only, and we are not liable to you for any business losses.

18.3

If you are a business User, to the extent permitted by law, we are not liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from your use of, or inability to use, the free Platform or your reliance on any Content. In particular, we are not liable for any loss of profits, sales, business or revenue; loss of business opportunity, goodwill or reputation; loss of anticipated savings; business interruption; or any indirect or consequential loss.

18.4

Our liability in relation to Paid Services is set out in our Terms of Sale.

18.5

We are not responsible for events run by clubs, grounds or other organisers, or for any dealings between you and other Users.

19. Viruses, Malware and Security

19.1

We use reasonable skill and care to keep the Platform secure and free from viruses and malware, but we cannot guarantee this.

19.2

You are responsible for protecting your own devices, software and data, including by using up-to-date virus protection.

19.3

You must not deliberately introduce viruses, malware or any other harmful material to or through the Platform.

19.4

You must not try to gain unauthorised access to any part of the Platform, the servers on which it is hosted, or any connected server, computer or database.

19.5

You must not attack the Platform by means of a denial-of-service attack or in any other way.

19.6

Breaching Parts 19.3 to 19.5 may be a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant authorities and cooperate with them, including by disclosing your identity. Your right to use the Platform will end immediately.

20. Acceptable Use

20.1

You must use the Platform lawfully and in line with our Acceptable Use Policy. If you breach it, we may take the actions set out in that policy, including suspending or closing your Account.

21. How We Use Your Personal Data

21.1

We will only use your personal data as set out in our Privacy and Cookie Policy.

22. Communications from Us

22.1

If you have an Account or have given us your contact details, we may send you important service messages by email. For example, we may tell you about changes to the Platform, these Terms of Use or your Account.

22.2

We will only send you marketing emails, such as our events digest or news, if you have agreed to receive them. Every marketing email includes an unsubscribe link, and we will act on your request promptly.

22.3

For questions or complaints about our communications, please contact us using the details in Part 3.

23. Other Important Terms

23.1

We may transfer our rights and obligations under these Terms of Use to another organisation, for example if we sell our business. This will not affect your rights.

23.2

If any part of these Terms of Use is found to be unlawful or unenforceable, the rest will remain in force.

23.3

If we do not enforce a right straight away, we can still enforce it later.

23.4

No one other than you and us has any right to enforce these Terms of Use.

24. Law and Jurisdiction

24.1

These Terms of Use, and the relationship between you and us (whether contractual or otherwise), are governed by the law of England and Wales.

24.2

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you live. Nothing in Part 24.1 affects your rights as a consumer to rely on those provisions.

24.3

If you are a consumer, any dispute between you and us relating to these Terms of Use may be brought in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.

24.4

If you are a business User, any dispute between you and us relating to these Terms of Use is subject to the exclusive jurisdiction of the courts of England and Wales.
